Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1042

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

In principle, actions have an ascertainable value, except actions brought seeking relief incapable of valuation. - Rules for assessing the value of an action. Their relation to public policy. The effect thereof. - An action to annul an order assessing fees, founded on exemption from costs pursuant to a judgment. Its correct characterisation is an action for a declaration of non-liability for judicial fees and costs, of unassessed value exceeding the Court of First Instance's threshold for final judgments. The judgment issued therein. Not final. It may be challenged by appeal. The challenged judgment's ruling that the appeal is inadmissible because the value falls below the threshold is an error in applying the law requiring its cassation.
