English translation of the principle

Arbitral award. Although it is an adjudication that determines a dispute and has preclusive authority, it is a judicial act of a special nature. The basis of that special nature. The arbitrator derives his jurisdiction from the parties’ agreement to arbitrate, not from the law as is the case with a judge. The consequence thereof. An arbitral award may not be appealed unless the parties agree to that before it is rendered.
