Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1249

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Constitution’s guarantee of the right of litigation to people. Does not prevent the legislature from regulating the exercise of this right. This includes arranging the courts and determining their jurisdictions and what falls outside their jurisdictions in accordance with practical and legal considerations worthy of regard. - A plea that Article 1 of Law 20 of 1981 establishing a circuit at the Court of First Instance to hear administrative disputes is unconstitutional, on the assertion that it deprives employees of their right to annul decisions other than those referred to therein, unlike the position of other individuals and military employees. Not serious. The reason therefor. Confusion between confiscating the right of litigation and defining the scope of judicial jurisdiction, and what equality means in terms of non-discrimination between members of the same category where their legal positions are identical.
