English translation of the principle
The Court of Appeal. Has no jurisdiction to hear an application for approval of a composition to avert bankruptcy for the first time. Its jurisdiction in that regard is limited to its capacity as a court hearing an appeal against the judgment rejecting it rendered by the court of first instance. Article 780/2 of the Commercial Code.
