English translation of the principle

The court of first instance’s omission, by mistake or oversight, to determine one of the claims. It is remedied by returning to the same court for its examination. The judgment may not be challenged by appeal in respect of that claim. The Court of Appeal may not proceed to determine it, so as not to infringe the principle of two-tier litigation. - 620 - Civil Procedure
