State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The second-instance court finding that the defendant was not served. It must not stop at declaring nullity, but must order that the action be remitted to the first-instance court for determination on its merits after the opposing party has been duly and lawfully served. Reason therefor: observance of the principle of litigation at two levels. Article 135 bis of the Procedure Law, added by Law 36 of 2002.
