Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1334

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Scope of appeal. Determined by what has been appealed and within the limits of the appellant’s claims. The Court of Appeal may not address adjudications of the court of first instance not covered by the notice of appeal. The reason therefor: the criterion for determining what is challenged on appeal is the appellant’s claims stated at the conclusion of the notice of appeal. The remainder of the court of first instance’s adjudication is not legally before it, and the Court of First Instance’s adjudication thereof becomes final and conclusive and may not be discussed anew before the Court of Cassation. 6- Court of Appeal:-
