Kuwait Court of Cassation principle number 245

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Where a provision is expressed in general terms, there is no scope for particularising it without a particularising qualification. Where it is explicit and clear, it may not be departed from or construed on the pretext of being guided by the court that rectified it and the legislature's intent.
