Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 247

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Legal rules exist or cease to exist according to the existence or absence of their operative rationale. Where the provision is general and unrestricted, there is no occasion to particularize or restrict it by reference to its underlying wisdom. - The obligation of a scholarship recipient or a person on study leave to serve the State or one of the institutions in which it participates for a period equivalent to that spent on the scholarship or study leave. Its meaning is that the phrase institutions in which the State participates is general and unrestricted, encompassing all forms of participation without any limitation. Example of the judgment's error in interpreting the provision.
