Kuwait Court of Cassation principle number 287

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that a lawyer is an agent whose relationship with the client is subject to the provisions of the general law concerning the relationship between principal and agent. The provision in Article 32 of Law No. 42 of 1964 concerning the legal profession empowering the judge to assess the lawyer's fees if the client disputes them. The subsequent amendment of that Article by Law 62 of 1996 and the exclusion of the previous provision concerning assessment of the lawyer's fees where they are disputed mean that the legislature intended thereby to leave this matter to the provisions of the general law, namely the provisions of the Civil Code on agency, owing to the absence of conflict. Example.
