Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 304

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

It is impermissible to disregard the special law in order to apply the general law, as this is contrary to the purpose for which the special law was enacted. - The Public Prosecution may request a declaration of bankruptcy of a client who ceases payment pursuant to the provisions of Law 41 of 1993, and the provisions of the Commercial Code are followed in matters for which the first law contains no provision. The request for a declaration of bankruptcy entails: prohibiting the client from travelling abroad, unless the court issues its decision lifting the travel ban. The challenged judgment’s adherence to this view. The objection to it in this regard. Unfounded. An example.
