Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 625

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Referral of an action from one court to another for connectedness. Does not require identity of subject matter, cause or parties. It suffices that a connection exists between the two actions such that determination of one affects the outcome of the judgment in the other. Assessment of this connection lies within the authority of the court of fact, provided it is reasonable.
