State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Whether a judgment may be challenged. In principle, this is governed by the legislation in force. Transition from the governance of the old law to that of a new law. New provisions regulating avenues of challenge. They do not apply to judgments rendered before their entry into force unless the law provides otherwise. Condition therefor. Their introduction of an avenue of challenge that did not previously exist or their abolition of an avenue that existed. Reason therefor. Example concerning the enactment of Law 40/1972 concerning cases of appeal in cassation and its introduction of the permissibility of challenging all judgments rendered by the High Court of Appeal.
