Kuwait Court of Cassation principle number 729

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The ordinary judiciary is the default holder of judicial jurisdiction. Anything else: an exception to this principle that may not exceed the sphere delineated for its jurisdiction. The determining consideration in establishing the jurisdiction of a judicial body is the relief sought by the plaintiff in his action. - The disputes that the arbitral tribunal has jurisdiction to adjudicate are civil and commercial disputes in respect of which the law concerning their arbitration was enacted. Disputes relating to an administrative contract fall within the jurisdiction of the Administrative Division of the Court of First Instance, to the exclusion of the arbitral tribunal.
