Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 739

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The provision in Article 14 of the Law of Procedure attributing subject-matter jurisdiction to the Court of First Instance, not to its circuits. Its meaning. The assignment of particular actions to circuits of that court by a decision of the General Assembly is not a matter of subject-matter jurisdiction but merely an administrative distribution of work among those circuits. Its implication. Any circuit has jurisdiction to adjudicate the dispute even if the General Assembly assigned it to another circuit. The challenged judgment reaching that conclusion. No defect.
