Kuwait Court of Cassation principle number 798

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Subject-matter jurisdiction. Is attributed in principle to the court, not to its circuits. Assignment of particular actions to different circuits by a decision of the general assembly. An administrative distribution of work among those circuits. Its import. Their jurisdiction to adjudicate the dispute even if the general assembly assigned it to another circuit. The exception. Cases in which the law specifically assigns subject-matter jurisdiction over particular matters to one of the court’s circuits. This does not preclude its hearing other matters falling within the court’s subject-matter jurisdiction. The condition therefor. That the law does not provide otherwise. - The labour circuit of the Court of First Instance. Its exclusive jurisdiction to adjudicate disputes arising from the application of the provisions of laws issued concerning employment in the private sector and the oil sector, and claims for compensation resulting therefrom. Does not preclude its jurisdiction to hear other matters as one of the court’s circuits.
