Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1050

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The trial court is bound, in its characterization of the action, by the facts and claims submitted to it. Example of an erroneous characterization: submission of the claim for partition among the claims contained in the statement of claim. Ruling that the action seeking partition was initially brought by the liquidator. Contrary to what is established in the case papers.
