Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1216

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judicial claim. Its nature. The scope of the action, whether for the parties or the judge, is determined by the judicial claim. An appeal transfers the action in the state it was in before the appealed judgment was rendered, in respect of what has been appealed. An action brought by a person solely on his own behalf. His statement on appeal that he brought it on his own behalf and on behalf of another constitutes a new claim outside the scope of the action.
