An appeal transfers the action together with the pleas and grounds of defence previously raised by the respondent, provided he has not waived them expressly or impliedly. The effect thereof. The appellate court must address his claims, grounds of defence, and pleas raised before the court of first instance.

الاستئناف ينقل الدعوى بما سبق أن أثاره المستأنف ضده من دفوع وأوجه دفاع مادام لم يتنازل عنها صراحة أو ضمنا. أثر ذلك. وجوب أن تعرض محكمة الاستئناف لطلباته وأوجه دفاعه ودفوعه المبداة أمام محكمة أول درجة.Original Arabic judgment citations
