Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1234

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The scope of a challenge. Does not extend beyond the judgment challenged. - The task of the Court of Cassation is confined to examining what was before the Court of Appeal. Not what had not previously been submitted to it. What the court of first instance decided and was not the subject of appeal becomes res judicata.
