Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1247

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The scope of the appeal is determined not by all the claims submitted to the court of first instance, but by those submitted to the Court of Appeal. - The Court of Appeal may not adjudicate matters not sought in the petition of appeal, since the appeal does not transfer them to it. - Appealing the principal claim directed against a particular opposing party does not bring before the Court of Appeal the alternative claim directed against another opposing party.
