Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1492

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Consolidating two actions differing in cause and subject matter for joint consideration does not result in their merger or in either losing its independence, unless the subject matter of the claim in each is the same, the subject matter of each is an aspect of its counterpart in the other, or the basis of the dispute is the same. Their consolidation in such circumstances results in their being regarded as a single proceeding; resuming one after a stay results in resuming the other. Example concerning the resumption of an appeal.
