Kuwait Court of Cassation principle number 1495

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Joinder of one action to another on grounds of connection does not require identity of subject matter, cause, or parties. It is sufficient that a connection exists between the two actions such that determination of one affects the manner of judgment in the other. Assessment of connection. A matter for the court of merits. - Joinder of one action to another does not deprive either of its independence from the other unless they are identical in parties, subject matter, and cause. - Argument on matters of fact. Impermissible before the Court of Cassation.
