State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Consolidating two actions differing in cause and subject matter. Does not cause either to lose its independence from the other. Consolidation resulting in their being considered a single proceeding. Its instances. - 274 - Civil Procedure - Connection between two actions. Its condition. The determination of one must be capable of affecting the determination of the other, such that their remaining independent would lead to contradictory judgments. - An action for the validity of precautionary attachment procedures and an action for a declaration of bankruptcy. Their basis and subject matter are the same: the debtors' failure to pay their debts. Consolidating them because of their connection and for a single judgment to be rendered in both. Its effect. The ruling in the action for a declaration of bankruptcy deeming it never to have been instituted extends to the second action.
