The plaintiff’s or appellant’s failure to take any procedural step within the time limit set for him by the court. Its effect. The court may impose a fine on him or order a stay of the action for a period not exceeding three months. The plaintiff or appellant may, within thirty days following the expiry of the stay, resume the proceedings in the action. Expiry of that period without resuming the proceedings. Its consequence. The court may - 298 - Procedure rule that the action or appeal is deemed never to have been brought. Its condition: that the defendant does not object, if present. This time limit is not subject to suspension or interruption except by force majeure.
