Kuwait Court of Cassation principle number 1795
State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Proceedings in an action or appeal must be resumed, where a stay has been ordered as a sanction, within thirty days of the end of the stay period. The reason therefor: expediting the pursuit of litigation procedures without delay, by serving the other party within the aforesaid time limit as a condition for constituting the litigation against that party. Submitting the renewal petition to the registry. Insufficient. Expiry of the time limit. Its effect: a judgment deeming the action never to have been brought is mandatory, unless the defendant or respondent objects. Example.
