Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1829

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The binding force of a judgment attaches to what it has definitively determined. What the judgment did not address in its adjudication does not exhaust the court’s jurisdiction. Its effect: a plea that the action may not be heard in that respect is inadmissible. Example.
