Kuwait Court of Cassation principle number 1833

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity of a judgment which does not extend to the originating statement of claim, and upon whose issuance the court of first instance exhausts its jurisdiction. Its effect. The Court of Appeal may go beyond declaring its nullity and determine the merits by a new judgment in which it observes the correct procedures. This does not deprive a party of a level of adjudication.
