English translation of the principle

The claimant is free to define the scope of the litigation as regards its parties unless the law requires particular persons to be joined in the action. - A party may join in the action anyone who could properly have been joined when it was brought. The manner thereof. - Joining parties in the action. A discretion afforded to the court. Criticising it for not exercising that discretion. Inadmissible. - Omission of a request to join new parties who were not parties to the action in which the appealed judgment was issued does not vitiate the judgment. Its failure to respond to a manifestly invalid defence. Does not vitiate it. - An action for dissolution and liquidation of a limited liability company. It is not mandatory to join all its partners. Articles 170, 172, 177, 215, 216 of the Commercial Companies Law. The exception. If the company's incorporation is unlawful. Article 97 of the same Law.
