State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Lineage to a deceased person may be established only within an action concerning a right or property against a proper opposing party under Sharia. The rationale thereof. - An intentional opposing party and a constructive opposing party in Islamic Sharia. The meaning of each. - A request to add a surname to a name, concerning which no action was brought within another right forming the subject of a genuine dispute asserted against the deceased’s heirs in the lineage action. Its effect. Inadmissibility of the action. A judgment’s contravention thereof vitiates it and requires its setting aside and a ruling that the action is inadmissible.
