Kuwait Court of Cassation principle number 2020

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The provisions of Law 5 of 1971 concerning the obligatory bequest are couched in general terms. Its effect. Its provisions apply to all Kuwaitis without exception or distinction between adherents of any school of doctrine. The reason for this: had the legislature wished to apply its provisions to one category to the exclusion of another, it would have expressly so provided. A judgment's contravention of this requires its cassation.
