Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2041

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The impermissibility of making new claims on appeal. A fundamental rule concerning public policy. An exception thereto permits adding wages, salaries, all ancillary amounts, and increases in compensation to the original claim after submission of the final claims before the court of first instance. The judgment's contravention of this and its rejection of the claim for additional compensation for the aggravation of the injuries. A violation of the law necessitating its cassation.
