The insurer's recourse action against the responsible third party. Its basis: subrogation by operation of law or by assignment of a right. - Transfer of the right to the assignee subject to lapse within the same period by which it is extinguished, and the debtor may plead against the assignee that the right has been extinguished by the passage of that period.
