English translation of the principle

Incidental indemnity action. Its independence from the original action. Consequence thereof. The claimant therein is obliged to pay judicial fees without this being contingent upon the court’s ruling on the costs of the action following its determination of the merits of the dispute between its parties. - The party seeking indemnity. He may not request judgment against the indemnifier for what the claimant in the original action requests be adjudged against the party seeking indemnity. His right is confined to seeking judgment against the indemnifier for whatever may be adjudged against him in respect of those claims. Example of a reasonable inference requiring the claimant in the incidental indemnity action to bear the costs of his action.
