A decision issued by the Public Institution for Social Security concerning any insurance entitlement prescribed under the provisions of Law 61 of 1976. The time limit for a grievance against it begins from the date the person concerned is notified of the decision, if this occurs before expiry of the thirty-day period specified for deciding the application for those entitlements. Expiry of this period without notification. A grievance must be lodged within the thirty days following - 441 - Civil Procedure its expiry. The reason: the legislature deems the expiry of this period a constructive decision of rejection. Subsequent notification to the person concerned of the issuance of an express decision rejecting the application does not affect the finality of this decision. Failure to lodge a grievance within this time limit. Its implication. The action claiming these entitlements is not preceded by a grievance. Its effect: its inadmissibility. Contravening this. An error in the application of the law. - Disciplinary proceedings:-
