Consolidation of 2 actions differing in cause and subject matter. Does not cause either to lose its independence from the other. Their consolidation resulting in their being regarded as a single proceeding. Its cases. - Connection between 2 actions. Its condition. The determination of one must be capable of affecting the determination of the other, such that maintaining each independently would lead to contradictory judgments. - An action for validation of conservatory attachment procedures and an action for declaration of bankruptcy. Their basis and subject matter are the same: the 2 debtors' failure to pay their debts. Their consolidation for connection and for a single judgment to be rendered in both. Its effect. The ruling in the action for declaration of bankruptcy deeming it never to have existed extends to the second action.
