Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2537

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Peaceful, open possession of immovable property for 15 years with the intention of ownership constitutes, under the system of barring the hearing of actions, a Sharia and legal presumption that the possessor is its owner. - Merely leaving the property, however long the period, without anyone interfering with it or usurping it and denying its owner's right thereto does not, under the system of the Majalla of Judicial Provisions, result in the extinction of its ownership right.
