State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Commencement of the time limit for appeal. The general rule is from the date the judgment is rendered. The exception is from the date of service of the judgment. Excepted cases. These include the case where the judgment debtor failed to attend all hearings without submitting a memorandum setting out the plea, and cases where that party failed to attend and to submit a defense memorandum at all hearings following the resumption of the action after it had ceased to proceed consecutively. - 537 - Civil Procedure - Disruption of the progress of the action and interruption of the sequence of its hearings without the judgment debtor attending or submitting a defense memorandum. The time limit for appeal does not begin for that party until the date of service of the judgment. An example concerning a stay of proceedings and disruption of the sequence of hearings due to striking out, and commencement of the time limit from the date of service.
