English translation of the principle

Implication: achieving confrontation without service suffices for their constitution. Basis therefor. - The respondent's submission before the Court of Appeal of a memorandum containing an incidental appeal, in the appellant's absence, seeking an increase in the maintenance awarded. Its necessary consequence. Service on the latter so that he may confront and respond to what is directed against him. The challenged judgment ruling the incidental appeal formally admissible and increasing maintenance despite the proceedings in the incidental appeal not having been constituted. A violation of law requiring its cassation. 3- Service commencing the time limit for appeal and grievance:-
