Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2857

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The process server delivering the copy to the administrative authority. He must send a registered letter to the person served. It suffices that he state this on the original service document, not its copy. The reason therefor. - The person serving the payment order recording on the original document that the residence of the person to be served is closed, that service will be effected through the police station, and that he sent a registered letter to the person served. This suffices for validity of service and commencement thereby of the period for filing a grievance, even if the delivered copy omits mention of sending the registered letter. The judgment ruling service void because the copy lacks this statement and consequently ruling the grievance inadmissible. An error in applying the law requiring its cassation.
