English translation of the principle

In the absence of the person to be served, the process server must deliver the copy to his agent, servant, or any spouse, relative, or relative by marriage residing with him. Necessity of recording all steps taken to effect service in its original and copy. Failure to record them and issuance of judgment in such circumstances despite the person served failing to attend. Its effect. Invalidity of the judgment. - Rejection of the plea of invalidity of service of the statement of claim, despite failure to record the absence of the person served in the document, on the ground that the servant's refusal to receive service means that the woman to be served was not present. This vitiates the judgment and requires its cassation. - 550 - Civil Procedure
