Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2901

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Investigation of the habitual residence legally regarded as a domicile valid for service. A matter of fact. The condition therefor. - Judgments must be based on clear, manifest, and sufficient reasons. Failure to do so renders the judgment defective for inadequate reasoning. An example of an inadequate response to a plea that the judgment appealed against is void because service of the statement of claim was void.
