Invalidity of service, although expressly provided for, does not arise if no prejudice to the litigant results. - Service of the appeal petition on the respondent at the respondent's lawyer's office as the elected domicile, and the latter's attendance at the hearing specified therein. This achieves the purpose of service and eliminates prejudice. Effect thereof. A plea that the appeal is inadmissible for failure to serve its petition. Inadmissible.

بطلان الإعلان رغم النص عليه لا يكون إذا لم يترتب عليه ضرر للخصم. - إعلان صحيفة الطعن للمطعون ضده على مكتب محاميه باعتباره الموطن المختار وحضور الأخير بالجلسة المحددة به. يتحقق به الغاية من الإعلان وينتفي به الضرر. أثر ذلك. الدفع بعدم قبول الطعن لعدم إعلان صحيفته. غير مقبول.Original Arabic judgment citations
