Claiming a debt evidenced by a commercial instrument where the person against whom payment is claimed is the drawer, maker, acceptor or aval guarantor of any of them. Its manner. Following the payment-order procedure. Claims against persons other than these follow the ordinary action procedure. Article 45 of the Civil Procedure Code. The judgment departing from this and issuing a payment order where the person against whom payment is claimed is not among those mentioned. An error in the application of law requiring its cassation.

المطالبة بدين ثابت بورقة تجارية حال كون المطالب الساحب أو المحرر أو القابل أو الضامن الاحتياطي لأي منهم. كيفيته. سلوك طريق أمر الأداء. المطالبة من غير هؤلاء تكون بسلوك طريق الدعوى العادية. م٤٥ مرافعات. مخالفة الحكم ذلك وإصداره أمر أداء حال كون المطالب به ليس ممن ذكر. خطأ في تطبيق القانون يُوجب تمييزه.Original Arabic judgment citations
