Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 328

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Obtaining a payment order. Its condition: the debt claimed must be a sum of money established in writing, ascertained in amount, and due for payment. - What is meant by the payment order being ascertained in amount is that determination of its amount rests on fixed foundations leaving the judiciary no broad discretion in assessment, and that the debt is not open to dispute. Its being the result of a simple arithmetic operation does not prevent it from being considered ascertained in amount. An example of a reasonable inference for obtaining a payment order.
