Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3282

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The process server's delivery of the copy for service to the administrative authority. The process server must send a registered letter to the addressee. It suffices to state this on the original service document, not its copy. The rationale therefor. - The process server's recording on the original document that the addressee's dwelling was closed, that service would be effected through the police station, and that a registered letter had been sent to the addressee. This suffices for the validity of service and the commencement thereby of the time limit for a grievance, even if the copy delivered lacks a statement that the registered letter was sent. A judgment ruling that service is invalid because the copy lacks this statement thereof and consequently ruling the grievance inadmissible. An error in - 628 - Civil Procedure application of the law requiring its cassation.
