Proceedings commencing with the filing of the statement of claim with the Registry remain conditional upon its valid service on the defendant. Failure to fulfil this condition up to issuance of the first-instance judgment. Its effect. Their extinction. The reason for this: the absence of confrontation between the litigants, so service remains the sole means of informing him of their particulars, and without service or confrontation the proceedings do not attach to him.

الخصومة التي تبدأ بإيداع صحيفة الدعوى إدارة الكتاب تظل معلقة على شرط إعلانها إلى المدعى عليه إعلاناً صحيحاً. تخلف هذا الشرط حتى صدور الحكم الابتدائي. أثره. زوالها. علة ذلك: عدم تحقق المواجهة بين الخصوم فيبقى الإعلان هو الوسيلة الوحيدة لإخباره ببياناتها وبدون الإعلان أو المواجهة لا تتصل الخصومة به.Original Arabic judgment citations
