Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 357

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The basic principle of the litigation system is that it comprises two levels, so new claims are not admissible on appeal. - A litigant’s limitation of the claims before the court of first instance to a request for appointment of an expert in preparation for requesting judgment in accordance with the outcome of the expert’s report. Its effect. The scope of the action is thereby defined without extending to a statement that judgment has actually been sought in accordance with the outcome of the expert’s work. The necessary consequence is that a claim for a judgment imposing an obligation before the Court of Appeal is a new, inadmissible claim.
