Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3678

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The knowledge that commences the three-year limitation period in an action for the non-enforceability of a disposition is the creditor's knowledge that the disposition was made, of the debtor's insolvency, and of the fraud committed by him. The court of merits has authority to ascertain such knowledge without review by the Court of Cassation, provided its inference is reasonable.
