Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3912

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The judge's authority to reduce interest, whether statutory or contractual, or not to award it. Conditions for its exercise. The creditor's fault is insufficient; his bad faith and deliberate intent to harm the debtor must be established. Merely advancing a defence that he fails to prove does not indicate bad faith. Its condition is that the defence be vexatious.
